BWCCC's Brown is Victorious in Lawsuit Against City of Cleveland

Court of Claims Command the City of Cleveland to Turn Over Records of Request


On September 29, 2018, Kimberly F. Brown (President of BWCCC) made a public records request to respondent City of Cleveland: Please submit the minutes, the agenda and attendance record from the closed and private meeting between Councilperson Joseph Jones of Cleveland WARD ONE and the residents of Cloverside Ave between the dates of August 13th and Friday September 21, 2018. This issue is regarding the Secondary Street Signage for Saniyah Nicholosn who was killed in Cleveland WARD ONE on June 20, 2018. The meeting was said to beheld at the Harvard Community Center.


The Cleveland Public Records Center acknowledged the request and advised Brown that her request will be forwarded to the relevant City department(s) to locate the information you seek". Brown received no further contact. On November 7, 2018, Brown filed a complaint pursuant to R.C. 2743.75 alleging denial of access to public records in violation of R.C. 149.(B). On January 3, 2019 a mediation was held between the parties, and it failed. The City of Cleveland filed for a motion of dismissal of the suit numerous times, and remained unsuccessful.


On March 28, 2019, the court of claims sided with Brown, "upon consideration of the pleadings, attachments and responsive records filed under seal, the special master recommend that the court issue an order granting the claim for disclosure of the meeting sign-in sheets. It is further recommended that Brown is entitled to recover from the City of Cleveland the cost associated with this action R.C. 2743.75 (F)(3)(b).

The ladies of BWCCC stood strong for the Daniels Family. We have commanded that the city of Cleveland and Councilman Joe Jones do right by this family. Saniyah deserves a proper and professional memorial. Whatever Jones does, it is because of the relentless actions by the ladies of BWCCC. We won in court - Jones needs to do right by this family; hamburgers and hot-dogs won't do. Saniyah deserves more than a low-budget memorial celebration held on the dirty streets of Lee Road - Cleveland, OH. Jones need to put that secondary sign up in honor of 9 year-old Saniyah Nicholson.
